Course Description

This is an opportunity to discuss and explore successful strategies to achieve your goals in collective bargaining.  Attendees should bring their challenging bargaining issues to share with the class and instructors to gain shared insight.

These topics, among others, will be covered by our program leaders.

  • How to plan for contract negotiations
  • Achieving fundamental change in collective bargaining
  • Negotiation in the context of the current economic times
  • Theme development and presentation – An advanced discussion
  • What role does data play in negotiations and what data do you need?
  • How to engage in concession bargaining
  • Costing the contract
  • Information requests – Demystifying a troublesome union tactic
  • Dealing with Board charges and grievances in the context of negotiations
  • Mediation – How to make it work for your organization
  • Understanding impasse and implementation – How it can help you achieve your goals
  • Strikes – Key elements of a strike plan that you need to know

This program is preapproved by the Society for Human Resource Management for 14 Professional Development Credits (PDCs) toward the SHRM-CP or SHRM-SCP.

Course Outline/Topics

A segment of the program is devoted to an open forum in which you and other workshop members can receive analysis and strategic planning ideas for your own negotiations from both the instructors and attendees. We will also deal with various hypotheticals and a case study to foster engagement during the course and encourage critical thinking.

Please have your collective bargaining agreement available for the program and bring your questions about items that you want changed.

 

Program Agenda

Negotiation preparation:

  • Learn how to apply economic value to items historically viewed as non-economic
  • Develop obtainable goals and objectives, as well as supporting data and documentation, for use at the negotiating table

Presentation of bargaining positions at the table:

  • Understand how to develop and communicate a theme for bargaining
  • Experience strategizing the negotiation of a comprehensive economic package addressing wages, health insurance and pensions

Role-playing to deal with intangibles encountered during negotiations:

  • How to handle a rogue union committee member
  • Become skilled at moving beyond the initial presentation of a position and focus on the organization’s objective
  • Respond to a union committee’s claim that it cannot sell a critical management demand

Special Feature:
One day of the workshop consists of analysis of a case study, discussion of hypotheticals, and most importantly, an open forum in which workshop members bring critical issues in their own negotiations (whether past or upcoming) for full discussion and analysis.

This interactive workshop is designed to allow participants to engage with one another on strategies, overcoming challenges, and learning better ways to achieve your bargaining goals.

Notes

Kristofor L Hanson

Kristofor L. Hanson is a partner with Michael Best & Friedrich LLP. He maintains a multifaceted management-side labor and employment practice focusing on representing employers in all areas of labor-management relations, including collective bargaining, labor arbitration and litigation in state and federal courts, as well as the defense of employers before state and federal administrative agencies.

Kris has successfully served as first chair and chief spokesperson in well over 100 negotiations of collective bargaining agreements on behalf of employers of all sizes, both in the United States and Canada. He represents employers in grievance arbitrations, combats union organizing campaigns, assists unionized clients with contract interpretation and administration and defends clients against unfair labor practice charges and in representation actions before the National Labor Relations Board.

Kris also advises employers concerning recruiting, hiring, discipline and termination decisions. He develops training presentations and conducts training for management personnel; creates, revises and updates employment policies and handbooks; performs due diligence in sale, acquisition and merger matters; drafts effective employment contracts, including covenants not to compete and confidentiality agreements; conducts harassment and other investigations and provides counsel on appropriate disciplinary actions at closing; and, serves as lead counsel in disciplinary hearings.

The continuing education unit (CEU) is a nationally recognized means to document participation in organized non-credit continuing education. One CEU is defined as 10 contact hours of participation in organized continuing education under qualified instruction. The CEU provides a vehicle for employers, professional groups, and licensing agencies to account for participation in non-credit seminars, workshops, and courses.

Privacy Policy


Cancellation Policy

To cancel, log into your student portal, go to "Enrollment History," and select "Request Drop" next to the course. Refund eligibility depends on notice, course type, and fee:

  • 30+ days prior to start of course: Full refund.
  • 15-29 days prior to start of course: Refund minus a 25% administrative fee.
  • Less than 15 days prior to start of course: No refund.

Exceptions (No Refunds):

  • Osher Educational Travel/Go Explore and College for Kids & Teens courses.
  • Courses with a fee of $35 or less.
  • On-demand online courses after the student has accessed the learning environment.
  • Conferences/Special Events (specific policy will be in registration terms).
  • Special requests and non-course fee items (e.g., memberships, textbooks) are non-refundable.

If the School of Continuing Education cancels a course, a full refund will be issued.


Invoicing Policy

  • If "invoice full amount" is selected, payment is due 14 days before the course start.
  • Failure to pay by the due date may result in cancellation of your registration.
  • For Agency payments (AmeriCorps, DVR, MyCAA, etc.), contact sceinfo@uwm.edu for next steps.
  • Automated payment reminders will be sent until the balance is paid.

Third Party Expenses

The School of Continuing Education does not provide refunds for any expenses (such as travel, accommodations, or materials) incurred by students due to a course cancellation or a student's self-cancellation. We strongly recommend booking refundable/transferable travel and accommodations, and purchasing materials with a return window extending beyond the course start date.


Collections Policy

Participants who fail to make timely payments agree to pay all collection costs incurred by UWM (agency fees, legal fees, etc.) and any late fees. UWM may also certify the past-due balance to the Wisconsin Department of Revenue and claim the total due against any refunds or payments owed to the participant.


Photography and Media Usage

The School of Continuing Education may take photographs, video, and other media during courses and events for educational, promotional, and advertising purposes. Virtual programs may be recorded for marketing and content sharing.


Conduct Information and Disciplinary Measures

No firearms or weapons are allowed on UWM property.

Participant conduct policies are based on the following UW System Administrative Codes, which may result in probation, suspension, or dismissal from all UWM functions:

  • UWS Chapter 14 – Student Academic Disciplinary Procedures
  • UWS Chapter 17 – Student Nonacademic Disciplinary Procedures
  • UWS Chapter 18 – Conduct on University Lands
